Although the majority of cases Pryor Law handles is personal injury cases, a substantial portion of its caseload is commercial litigation. About two years ago, a breach of contract case was referred to Pryor Law. Another attorney prepared the case for trial and then referred it to Pryor Law to serve as the trial attorneys.

On March 7^th, after a several days long trial, the jury returned a verdict in favor of Pryor Law’s client, the Defendant. Ted Pryor was lead counsel and Will Forero assisted at trial.

The defendant, a small family owned construction company, was being sued by a former employee who had been fired for theft, as well as for poor performance. The employee brought an outrageous claim against the company alleging that the company made an agreement with him to share half of all profits. This agreement was never made and there was no evidence, except for the Plaintiff’s own testimony. At trial, the Plaintiff asked the jury to find that he had a verbal contract with the company and that the jury should award him $600,000 as his share of the profits.

Pryor Law represented the defendant, which counterclaimed against the Plaintiff. Pryor Law asked the jury to find that there was no verbal contract. Additionally, the Defendant sought compensation for $64,354 that the plaintiff stole.

At trial, we were able to establish that there was no verbal contract between the Plaintiff and the company. Ted was able to show through a thorough cross-examination of the Plaintiff that the Plaintiff was not a credible witness and that he had no evidence to show that this agreement ever existed. Ted also successfully demonstrated that the Plaintiff wrote himself $64,354 in checks without any authorization from the company.

The jury found that the company did not owe the Plaintiff anything because there was no verbal contract and that the Plaintiff owed the company $64,354 because he wrote himself checks totaling this amount without company authorization.
